Terms & Conditions of Business

ToolandFix Online is a company registered in England & Wales, Company No.07120860. VAT No. 130856718, trading as Tool and Fix. The company registered office is at 13 Prenton Way, North Cheshire Trading Estate, Prenton, Merseyside, CH43 3DU.

When you (the person named on the order) place an order with us we do business together under the following terms:

  1. Ordering

    Tool and Fix makes every effort to provide full and accurate information on its website of all goods offered for sale. The information is the same as that provided in the manufacturer’s brochure. As such we cannot be held laible for the veracity of the information provided. We do not send out brochures or publish a catalogue of our own but should you require further information or advice about a product on our website you are welcome to email your query to our customer service team at sales@toolandfix.com.

    On receipt of payment, Tool and Fix will send you an automated order confirmation/payment receipt by e-mail to the e-mail address provided by you. However, please note that this confirmation does not constitute acceptance of your order. This is only done once we have dispatched the goods to you. There is one exception to these order acceptance terms and that involves the purchase of any of our items in 'bulk'. Bulk is defined in this instance as being in excess of five x one item type or any consignment that will require a palletised delivery. As it is likely that we would have to order in additional stocks to satisfy the order, we cannot accept cancellation of the order while it is being processed/assembled for you. If you do cancel, we reserve the right to charge you a re-stocking fee.

  2. Prices

    We offer goods for sale through, our website www.toolandfix.com. Prices are subject to frequent change in our industry and Tool and Fix updates its website several times a day in order to keep up with these fluctuations. However we are unable to accept orders based on earlier (lower) pricing that may have been cached on the web. In the event that a supplier fails to inform us of a price rise, we may need to pass this increase on to you, but we will not process your order unless you are aware of the price increase and are willing to pay it

    Similarly we are unable to honour prices that have been published on third party websites (eBay, Amazon, Google Shopping, etc) that have not been updated by those parties (for whatever reason) such that they do not accurately reflect the prices on our website.

    Our prices vary from time to time and printed material such as leaflets or advertisements will always show our best prices at the time of printing. During the valid period of a leaflet/advertisement we may offer products at a lower price. This could be a special offer or just an everyday price cut. Our website will always show one price, the lowest price we have, and if you order from a catalogue which quotes a higher price we undertake to process your order at the lower price. We will always use the lowest price we are quoting at the time that your order is processed and this will never exceed the valid prices published in our catalogue.

    Our delivery charges are clearly displayed on every prodcut page and will be confirmed at the checkout phase of processing your order.

  3. VAT

    The prices we quote include VAT at the applicable rate. Please note that we also publish our website prices inclusive and exclusive of VAT for the benefit of our trade customers.

    Our VAT number is 112 8379 21.

  4. Payment

    All of our goods are offered to you on a payment with order basis. We do not offer credit terms. We accept most credit and debit cards and will also accept BACS payment (bank transfers) by prior arrangement. We also accept payments via PayPal.

  5. Dispatch

    Our standard delivery schedule is 1-3 working days from the date of order. Please note, daily cut off time for orders is 4.00pm. You will receive a dispatch email from us to confirm that your order is on its way to you. Our couriers will normally back this up with an email or text notification/confirmation of when you can expect delivery. The goods become your responsibility as soon as they are dispatched to you.

  6. Delivery

    We will deliver your order to any UK address. Our standard delivery service involves the use of a reputable, national courier service and in most cases they deliver on a next working day basis. If you live in a remote area (e.g. the Highlands of Scotland) or the carrier finds your address more difficult to find, your delivery may take a little longer. Carriers plan their activities at the last moment in order to achieve the quickest turn-around for the greatest number of items. It is therefore not possible to book a delivery time, although we will make every effort to arrange a date convenient for you.

    If a quicker delivery is important, you may request one of our premium delivery options. Availability of these depends on where you are and in some cases the time of day. This will be confirmed with you at the time you place your order.

  7. Receiving Orders

    Unless we have your written authorisation, we will always require an authorised signature when delivering goods to you. If you receive goods that are defective or have been damaged in transit, it is important that you follow our Returns & Refunds Policy. We cannot accept any notifications of damages or missing items where we are informed later than 7 days after you have taken delivery.

  8. Availability

    We aim to keep sufficient stocks of all products on hand at all times. However, in times of unexpectedly high demand stocks may deplete to the point that your order is delayed. However, we are able to replenish stocks quickly and so any delay is likely to be minimal. If you have opted for a premium delivery service, or we are expecting a longer than usual delay, we will keep you fully informed of progress. You are encouraged to contact us at any time to check on the progress of your order.

  9. Cancellation

    You have the unconditional right under Distance Selling Regulations to cancel an order within 10 days, starting from the day after the goods are delivered. 

    If you wish to cancel the order you should do so by email at sales@toolandfix.com and we will confirm that it has been possible.

    If the goods are not faulty and you are returning in the cooling off period you will be responsible for all carriage costs. We also reserve the right to charge you a 're-stocking fee' which is sufficient to cover any losses that we incur as a result.

    You are responsible for the care of the goods whilst in your possession and for returning them in good condition in the original packaging including all documents, swing tickets and manuals.

    Tool and Fix will reimburse you in full for the goods if they are returned as new and in resellable condition. If the goods are found to be used, misused or damaged on return, we reserve the right to charge you a cancellation fee which is sufficient to cover any losses incurred plus any handling/administration costs. 

  10. 30 Day Refund

    Once your order has been dispatched you may return the goods at your expense for a full refund, without giving a reason, provided the goods are with the original packaging, in unused condition and you do so within 30 days of purchase. This only applies to items we have sold to you from stock. Any special orders are non returnable.

  11. Our 12 Month Guarantee

    If any of the goods we supply fail to perform satisfactorily due to faulty parts, materials or workmanship you may return it/them to us for a refund at any time within 12 months from the date of purchase. All we ask is that you provide an explanation of the problem and details of the purchase. Some of the goods we sell carry longer manufacturers’ warranties. Our 12 month guarantee is intended to give you additional piece of mind and is not as a substitute for the manufacturer’s warranty.

  12. Our Mistakes

    We are constantly updating our products prices and offers. We are confident of our technology and staff but acknowledge that human error is always possible. If goods are offered for sale incorrectly we will always try to honour our offer. There may be rare circumstances where it is not possible for us to do so. In such cases we will contact you and explain the situation, if we are unable to resolve the matter fairly with you we reserve the right to refuse your order and refund any payment you may have made.

  13. Unforeseen Circumstances

    If performance of any of our obligations to you is prevented, frustrated or impeded by reason of acts of God, war and other hostilities, civil commotion, acts of terrorism, accident, strikes, lock outs, trade disputes, acts or restraints of Government, imposition or restrictions of imports or exports or any other cause not within our reasonable control, we will do our best to maintain our deliveries. However, we shall have no liability to you for any failure which is due to such unforeseen circumstances or any other situation outside our control.

  14. Age Restrictions

    Age restrictions apply to the supply of some goods. By ordering these goods you confirm that you are over 18 and that the person receiving the delivery is also over 18.

  15. Liability

    The terms and conditions of business are not intended to affect your statutory rights or to limit our liability for death, personal injury or fraudulent misrepresentation resulting from our negligence. If there is a problem you may receive a refund or replacement under the terms of our guarantee. Our liability to you will always be limited to a full refund of the goods purchased. We will not compensate for delivery delays or failures unless you have requested a premium delivery option. In these circumstances our liability to you will be limited to a refund of the delivery charges you have paid. Our liability to you specifically excludes compensation for indirect or consequential loss or damage however it arises and except as described above will always be limited to a refund of your payment. 

  16. Law

    The terms and conditions of business will be interpreted and adjudicated under English law.
